Key points
  • Taiwan's Legislative Yuan passed the AI Basic Act on 23 December 2025, setting a framework for national AI policy.
  • As a framework law, much of the detail is left to government agencies; existing laws on personal data and employment still apply.
  • The Employment Gold Card includes a digital field, which helps companies hire experienced foreign AI and digital talent.

Taiwan has moved to set a legal foundation for artificial intelligence. For companies adopting AI and hiring AI talent, the practical question is what changes now and what to watch.

The AI Basic Act

The Legislative Yuan passed the AI Basic Act on 23 December 2025. It is a framework law: it sets out the government's direction and responsibilities for AI development and governance, including a national AI strategy committee convened by the Executive Yuan, and leaves detailed rules to the relevant agencies over time.

What still applies today

AI does not sit outside existing law. When companies use AI at work, the Personal Data Protection Act governs how personal data is collected and used, and employment laws, including the Labor Standards Act and equal employment rules, continue to apply to hiring and workplace decisions. A simple internal AI policy on approved tools and data use is a sensible step for any company.

Hiring foreign AI and digital talent

Taiwan's Employment Gold Card combines an open work permit, resident visa and alien resident certificate for qualified professionals. It includes a digital field administered with the Ministry of Digital Affairs. Published criteria include, for example, at least eight years of relevant experience in the digital economy, or a recent monthly salary of at least NT$160,000 in a relevant role. Check the official Gold Card website for current requirements.

What employers should do

  • Follow agency guidance as rules under the AI Basic Act develop.
  • Write an internal AI policy covering tools, personal data and human review.
  • Plan AI hiring early, including foreign talent routes where local supply is short.
